Update: Phelps man indicted on murder charge, 37-year-old accused of pulling the trigger still in Florida

On Tuesday, Seneca County District Attorney Mark Sinkiewicz provided an update on the Waterloo homicide investigation that has now resulted in a grand jury indictment.

“The Grand Jury returned an indictment which was filed today in County Court charging [Christopher] Kesterson with Murder in the Second Degree and Criminal Possession of a Weapon in the Second Degree. No date has been set yet for his arraignment. He remains remanded in jail at this time,” Sinkiewicz told FingerLakes1.com on Tuesday.

Moving forward all appearances will be in Seneca County Court.

We reached out to Kesterson’s attorney, John Nabinger with the Seneca County Public Defender’s Office, but have not heard back yet.


Another man charged in the murder still in Florida

Sinkiewicz said he is still working to have the other man charged in the shooting, 37-year-old Wayne Ellison, of Waterloo, extradited from Florida to answer to murder charges.

Investigators said Ellison shot 33-year old William C. Waugh of Euless, Texas in an enclosed porch at a home where a wedding was planned on Route 96.

Investigators added that Kesterson provided assistance to Ellison in the shooting.
