Rochester man refuses to submit to a breath test, chemical test after traffic stop

A Rochester man was arrested following investigation into a traffic stop that occurred in Ontario.

Wayne County Sheriff’s arrested Donald S. Warnick, 52, of Rochester for driving while intoxicated, refusal to submit a breath test, open container, and multiple traffic violations.


Warnick was observed operating a vehicle erratically on State Route 104 in Ontario. Deputies attempted to administer standardized field sobriety testing and Warnick failed to cooperate. He was transported to the Wayne County Sheriff’s office where he then refused to submit to a chemical test.

Warnick was remanded to the Wayne County Jail to await arraignment and will answer charges before the Town of Ontario Court at a later date.
