83-year-old charged with homicide after incident at Penn Yan nursing home

Police arrested an 83-year-old man following a death investigation in Penn Yan.

According to a news release, James Dennis O’Reilly, 83, was charged with criminally negligent homicide and endangering the welfare of an incompetent or disabled person.

He was arrested after an investigation into an assault that happened on March 28 at a local nursing home. It’s alleged that O’Reilly got into an argument with another resident named Lee Lockwood at the facility — pushing him to the ground. 


Lockwood, an 89-year-old resident of the facility that was not identified, died at Geneva General Hospital from injuries sustained in the fall.

Police arrested O’Reilly on Thursday, March 31. He was arraigned and released in according with state standards. 

The Penn Yan Police Department says they’re working with the state Department of Health, as well as the unnamed nursing home facility, and Yates County Adult Protective Services on the matter.

A court appearance is scheduled for a later date.
