Former Governor Andrew Cuomo’s lawyer Rita Glavin, along with former top aides, have called into question some of the sexual harassment allegations levied against Cuomo. They cite documents from pre-trial discovery in the now-dismissed criminal case against him as evidence of inconsistency in his accusers’ accounts.
Notably, those same documents detail instances where Cuomo admitted to inappropriate behavior such as kissing, touching, and hugging his aides as well as a female trooper on one occasion. Although the New York State Attorney General’s office found accusations against Cuomo to be credible, they say that under NYS statutes, the allegations could not be successfully prosecuted, according to the Times Union.
Now, Glavin and Cuomo’s former top aides say other records that were not publicly released by the NYS AG’s office reveal that investigators did not follow up on leads that could have cast doubt on accusers’ sworn testimony.
One example of so-called misleading testimony comes from Cuomo’s former aide Lindsey Boylan, who brought forth some of the most serious allegations against Cuomo. Glavin says unreleased records reveal Boylan was not entirely truthful about her relationship with former CEO of Empire State Development Howard Zemsky, thereby calling into question her credibility.
Another apparent inconsistency came from Cuomo accuser Brittany Commisso, a 33-year-old Executive Chamber staff member who could not recall the exact date of an alleged groping incident, where she says Cuomo touched her breast as he hugged her.
“Another day, another attempt by the former governor to attack the brave women who called out his abuse,” said Attorney General Letitia James’ office in response to Glavin’s attacks on the credibility of their investigation. “Thousands of pages of transcripts, exhibits, videos, and other evidence have already been publicly released, but these lies continue in an effort to mask the truth: Andrew Cuomo sexually harassed multiple women.”
