Two men in the Cayuga County Jail are receiving time for separate child pornography cases.
On Tuesday, Mark E. Koziol, 67, stood before Judge Mark Fandrich in Cayuga County Court for a sentencing. He pleaded guilty earlier this month to promoting a sexual performance by a child, a class D felony.
Jon Budelmann, Cayuga County District Attorney, noted the defendant’s age as well as it being his first time involved with the criminal justice system.
Koziol’s attorney, Rome Canzano, stated that his client has significant medical ailments and that he was ashamed and embarrassed of what he did.
Koziol spoke and accepted full responsibility for his actions.
Judge Fandrich noted that while Koziol was accepting of responsibility, the crime was serious.
He was sentenced to shock probation of 6 months in jail and 10 years of probation. He will register as a sex offender.
John Wilczek, 67 of Auburn, faced Judge Fandrich virtually for pleading guilty to promoting a sexual performance by a child.
Budelmann stated that after Wilczek’s arrest in March of 2020 he remained in jail after being found with 400 items of child pornography and had no prior criminal history.
Wilczek received shock probation of 6 months in Cayuga County Jail and 10 years probation. He will also have to register as a sex offender.
