On June 3, Child Protective Services notified deputies of a small child who was being treated at Strong Memorial Hospital.
Following an investigation of the baby having multiple rib fractures, leg fractures and possible arm fractures, The Livingston County Sheriff’s Office arrested 22-year-old Dustin Smith, of Nunda.
It is alleged that Smith caused these injuries when beaconing frustrated with his child while in his care.
The charges include two counts of first-degree attempted assault, two counts of first-degree reckless endangerment, and two counts of endangering the welfare of a child.
The baby is with family away from the home and an order of protection is in place keeping Smith from having contact with the baby.
Smith is being held in the Livingston County Jail on $15,000 cash or $30,000 bond.
