Auburn man charged with murder in 2019 Delevan Street shooting

On Friday, the Cayuga County District Attorney’s Office announced that Christian Rivera, 34, was formally charged with second degree murder, first degree attempted robbery, and conspiracy following the shooting death of Joshua Poole, 34, of Auburn.

The homicide occurred at 8 Delevan Street in Auburn in November 2019.

District Attorney Jon Budelmann said that Rivera was also charged with possessing a weapon illegally.

He was arraigned virtually at the Cayuga County Jail and then remanded to the Cayuga County Jail. Rivera is due back in Cayuga County Court again January 28th.


On January 23rd the co-defendants Lucciano V. Spagnola, Tyree L. Anglin, and Gage Ashley were arraigned on indictments and still remain in custody. Following the first three defendants’ arrests and indictment by the Cayuga County Grand Jury, the investigation continued and resulted in Rivera’s indictment.

The evidence collected supports that Rivera planned an armed robbery that resulted in the shooting death of Poole. Rivera supplied weapons, ammunition, and money to those involved. Then after providing Spagnola, Anglin, and Ashley with marijuana, cocaine, synthetic drugs, and alcohol, in the early morning hours of November 15th he sent them out to commit an armed robbery while he stayed at home.

“I would like to thank the members of the Auburn Police Department, New York State Police Troop E, Cayuga County Sheriff’s Office, United States Marshalls, Cayuga County 911 Center, Onondaga Medical Examiner’s Office, and Cayuga County District Attorney’s Office who worked on the investigation of this homicide,” Budelman said.
