Lawyer: Webster home invasion shooting appears justified based on available information

Law enforcement in Webster were left investigating in a residential neighborhood after a homeowner shot an alleged burglar during the early-morning hours on Tuesday.

It happened on Gravel Road around 1:30 a.m.

The person who was shot was listed in critical condition after the incident at a local hospital.

Not a ton of information has been released about the incident or investigation – but an attorney tells News10NBC that the shooting appears justified at this point.


New York doesn’t have any ‘stand your ground law’, and effectively expects people in dangerous situations to retreat.

“The officers on the scene made a judgment call that the homeowner was acting reasonably,” Lawyer Eugene Welch told News10NBC. The District Attorney’s office would also have a role in that process.

At the end of the day, Welch contends that the individual threat the burglar posed to the homeowner is what could make-or-break a case like this one. “It’s all fact-specific as to what actually happened and what was reasonable at the time for the homeowner to believe,” he added.
