Federal judge backs up Cuomo’s eviction freeze; calls it constitutional

A federal judge says Governor Andrew Cuomo acted constitutionally when he temporarily banned evictions due to COVID-19.

Judge Colleen McMahon said in a written decision Monday that the eviction moratorium does not violate the First Amendment rights of three large landlords who sued the state.


The judge said that the order occurred as the world was left dealing one of the deadliest pandemics in decaes.

Besides barring evictions Cuomo’s order permits tenants to use security deposits toward rent.
