Driver involved in fatal crash with Rochester police officer in Canandaigua ticketed

The driver of the vehicle involved in a fatal crash with a bicycle earlier this month has been charged with a traffic violation.

James Miller, 70, was charged with failing to use due care to avoid colliding with a bicyclist. It’s a traffic infraction.

Deputies say Miller attempted to avoid the bicyclist, who was Rochester Police Department Lt. Aaron Colletti. However, in the process – Miller failed to provide adequate space for the officer as he began the passing maneuver.

Drugs and alcohol were not contributing factors. Miller is due in court at a later date.
