Penn Yan boy allowed to return to school after supreme court ruling

A Penn Yan boy who had previously been banned from going to school after a change in laws around vaccination in New York has been granted entry.

News10NBC reports that the state Supreme Court ruled that Thorn Schwartz could return. The 11-year-old is an autistic child who was denied a medical exemption, and was prevented from attending school in Monroe County.

Schwartz, the son of Penn Yan attorney Carl Schwartz, was allowed to return to school back in February. However, that was only possible through a temporary restraining order.

Judge Dan Doyle issued the full-ruling, pointing out that the New York State Department of Health overreached when it issued new rules taking away certain vaccine exemptions – adding the state Legislature is responsible for those measures.
