Sheriff Barry Virts says the sex abuse charges filed and dropped last week against a Sodus resident have been re-filed.
In an updated press release Wednesday afternoon, Virts said that Robert J. Olmstead, 51, of Sodus was arrested after an investigation that spanned nearly one year.
Olmstead was accused of engaging in oral sex with a 10-year-old female in July 2012. The child was in his care at the time; and the incident is said to have occurred at his home in the Town of Palmyra.
Olmstead was charged with first-degree criminal sex act in late-September. However, the charges were dropped against him in Wayne County Court.
While it was unclear why the charges were dropped at the time, Wayne County District Attorney Mike Calarco told WHEC-TV that the dismissal was due to insufficient evidence. Calarco said he did not agree with that assessment.
Sheriff Virts says that the same charges were re-filed against Olmstead on Wednesday.
He was taken tot he Wayne County Jail pending arraignment on the newly filed charges, according to Virts.
