After pleading guilty to manslaughter charges in the death of his girlfriend and her son, Alberto Reyes is due back in court.
This time he’ll appear before a federal judge in Rochester for a plea hearing on Monday.
After Reyes became a suspect in the Hidalgo Calderon case the Wayne County Sheriff’s Office sent his fingertips to Immigration and Customs Enforcement. They determined Reyes had no valid immigration status and was illegally present in the U.S.
Federal sentencing guidelines obtained by News10NBC show the attorney is prosecuting Reyes for fraud and misuse of a permanent resident card. He faces a maximum of 10 years behind bars. He’s also charged as a removed alien found in the United States which has a max sentence of two years.
