Proposal would lower DUI alcohol limit in New York

During a happy hour or a weekend with friends, it’s not uncommon to have a few drinks.

But the amount of alcohol one can have and get behind the wheel – without breaking the law – could be changing.

In New York State, the legal limit is .08.

Anything above that blood alcohol content, and the driver can be arrested and charged with drunk driving.

But a bill in the New York State Assembly could lower the legal limit to .05. Anything above a .12 would be considered aggravated DWI. Right now, that limit is .18.
