20-year-old, teen charged for Penn Yan weekend incidents

Miranda B. Elwell, age 20 of Keuka Street in Penn Yan, and a fourteen-year-old female juvenile, also of Penn Yan, were arrested by Penn Yan Police on Sunday evening after an investigation into several incidents over the weekend.

On Friday at 5:40 pm, the two were observed by a Penn Yan Police Officer making graffiti on the bridge wall on the Outlet Trail underneath the Liberty Street Bridge.

On Sunday morning at 3:00 am Village Police stopped the two walking on Wagener Street as the juvenile was out past curfew in violation of Village Code.

Later Sunday morning, a local business filed a complaint of two females that shoplifted two cell phone chargers around 5:00 am. Elwell was caught on surveillance video taking the items and having the juvenile conceal them, then leaving the business without paying.

After an investigation, Elwell was charged with petit larceny and endangering the welfare of a child. She was also charged with making graffiti. She was arrested and arraigned in Penn Yan Village Court where she was remanded to the Yates County Jail on $500 cash bail or $1,000 bond.

The fourteen-year-old was charged in Yates County Family Court with petit larceny and making graffiti. She will answer the charges at the Yates County Probation Department at a later date.

Subsequent to the investigation, Charles M. Kennedy, age 42 of Penn Yan, was arrested as the parent of the juvenile. He was charged with endangering the welfare of a child and village curfew violation for failing to exercise supervision and control over the juvenile and preventing her from becoming a juvenile delinquent. Kennedy was issued an appearance ticket to appear in Penn Yan Village Court at a later date.
